These Terms and Conditions constitute a legally binding agreement between you ("you" or "Client") and Element Websites ("we," "us," or "our"), concerning your access to and use of elementwebsites.com and our web design and development services. By accessing our website or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please discontinue use immediately.
We reserve the right to update these Terms at any time. The "Last updated" date above will reflect any changes. Your continued use of our website or services after changes are posted constitutes acceptance.
Our services are intended for users who are at least 18 years old.
Element Websites provides web design, web development, and related digital services including custom website design and development, template-based builds, website hosting and deployment via Cloudflare Pages, domain and DNS configuration, website maintenance, and consulting. All projects are subject to a separate written proposal or service agreement executed between Element Websites and the client. These Terms apply to your general use of the Site and do not replace any executed service agreement.
A non-refundable deposit is required before work begins, with the remaining balance due upon project completion before the site goes live or files are delivered. Specific deposit amounts and payment schedules are outlined in your project proposal. All payments are processed through Stripe. We do not store credit card or financial account information. Please review Stripe's privacy policy for details on how your payment information is handled.
All fees are non-refundable once work has commenced unless otherwise stated in writing.
Element Websites uses a client support portal at support.elementwebsites.com for managing projects, invoices, and support requests. Information entered into or generated through these tools is stored securely and used solely to manage your project and communicate with you. We do not sell your data to third parties.
Upon receipt of full payment, you own the custom design assets and code created specifically for your project. Ownership transfers only after all outstanding invoices are paid. We retain ownership of all pre-existing tools, frameworks, code libraries, and templates used in delivering your project, which are licensed to you for use within your delivered website only. We also retain the right to display completed work in our portfolio and marketing materials unless you request otherwise in writing before project completion.
By using our website or services, you represent and warrant that:
You may not use our website or services to engage in unauthorized data collection or scraping, upload or transmit malicious code or spam, attempt unauthorized access to our systems, publish unlawful or infringing content, or use our services in any way that violates applicable law.
Our website and services may integrate with or link to third-party platforms such as Cloudflare, Stripe, Google Analytics, and others. These third parties operate independently and have their own terms and privacy policies. We are not responsible for their practices and encourage you to review their policies directly.
We use Google Analytics (property ID: G-3WV5Y56HR7) to collect anonymous, aggregated data about how visitors use our website. No personally identifiable information is sent to Google Analytics. You may opt out using the Google Analytics Opt-Out Browser Add-on.
Our website and services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. We do not warrant that our website will be uninterrupted or error-free, or that our services will achieve any particular search engine ranking or business outcome.
To the fullest extent permitted by law, Element Websites and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services. Our total liability for any claim shall not exceed the total amount you paid us in the three months prior to the event giving rise to the claim.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law provisions. Any disputes arising from these Terms or your use of our services shall be resolved in the courts of Erie County, Pennsylvania.
